Accident Overview
On February 27, 2016, at 11:47 am, our client was walking southbound on Lakeshore Avenue in Oakland, CA, county of Alameda, and was on the East sidewalk. She was struck by a driver in a 2004 Volvo also traveling on Lakeshore Avenue.
About the Accident
This was a wheelchair pedestrian versus SUV accident that resulted in serious injuries to our client based on the other driver’s negligence. Our client was seat-belted in her motorized wheelchair and passing the 76 gas station driveway located at 3200 Lakeshore Avenue when she was struck by the driver of the Volvo. The force of the crash caused our client’s wheelchair to flip over on the right side and topple her to the ground.
There were no adverse road conditions and this accident was caused by the negligence of the adverse driver. The adverse driver had Farmer’s Insurance.
Case Facts
Our client suffered from severe injuries to her right shoulder as well as scrapes to her right elbow. She was transported by Ambulance to Kaiser Hospital Oakland where there was a trauma activation. This is due to the fact that she has been in a previously compromised situation which is what left her in a wheelchair.
Our client needed ongoing medical treatment which included extensive physical therapy. Our client was charged large medical bills from this accident. Based on this information, she reached out to GJEL Accident Attorneys to see if she was entitled to compensation and to have her questions answered. She wanted to know:
- Who is responsible for my medical bills?
- How will I pay these bills?
- What if I have additional permanent lifelong damage to my body?
The staff at GJEL were able to quickly evaluate the case over the phone and send an investigator to meet her.
Based on the serious injuries from this accident and the mounting medical bills, our client decided to retain GJEL Accident Attorneys to help get her life back on track after this tragic accident.
The staff at GJEL started a full investigation which started with getting the police report from the Oakland Police Department. The police report showed that the other driver was 100% at fault and responsible for the accident. At first, Farmers Insurance was not willing to pay for our client’s medical bills and pain and suffering but Attorney Jim Larsen was ultimately able to settle the case before trial. Attorneys Andy Gillin and Jim Larsen helped the client through this difficult time and in the end our client was awarded $475,000 by Farmers Insurance after aggressive representation.
