GJEL Accident Attorneys represented an 84-year-old Clayton man in this case. He had a habit of walking several miles each day as a way to stay in shape, and was considerably more active than most people his age. While out for his usual walk one day, he was involved in a pedestrian accident with a delivery van. The client was crossing the street in front of the van, and the van driver failed to stop and failed to look for pedestrians when he rolled through his stop sign and into the client.
The defendants in this case were the driver of the delivery van and his employer. The defense argued that there was no crosswalk, so the driver did not expect pedestrians, and that the client darted out in front of the truck.
However, California law requires vehicles to yield to pedestrians. GJEL Accident Attorneys demonstrated with photos of the intersection and photos of the interior of the delivery van that there was no reason for the driver to have not seen the pedestrian other than his own failure to pay attention. Additionally, GJEL Accident Attorneys demonstrated that the client’s regular and relatively strenuous activity prior to the accident was severely diminished as a result of the accident. GJEL Accident Attorneys were able to obtain $250,000 for this client.
