Accident Overview
On October 16, 2012, at 4:25 p.m. on Bollinger Canyon Road, 300 feet east of Highway 680, city of San Ramon, county of Contra Costa, state of California, our client was a passenger in her husband’s car. Her husband was obeying the rules of the road driving her 1995 Isuzu Trooper when another driver hit that vehicle causing a serious car accident. The accident resulted in the loss of work, serious injuries, and large medical bills leaving our client in a state of uncertainty.
About the Accident
This was a two-vehicle accident that resulted in moderate injuries for our client due to the other driver’s negligence. The driver of the other car that caused the accident was driving a 2005 Accura MDX.
There were no adverse road conditions. After the accident, our client suffered from moderate back and neck injuries as a direct result of the car accident. Two days after the accident our client went to Washington Hospital for treatment for soft tissue injuries. The driver that caused the accident was insured by State Farm Insurance while our client was insured by Geico Insurance.
Case Facts
Initially, the auto insurance company for the party at fault questioned the number of damages and questioned who was at fault. Our client missed a significant amount of work and was charged large medical bills from this accident.
Based on this information she reached out to GJEL Accident Attorneys to see if she was entitled to compensation and to have her questions answered. She wanted to know:
- Who is responsible for my medical bills?
- How will I pay these bills and the loss of work?
- What if I have permanent lifelong damage to my body?
The staff at GJEL were able to quickly evaluate the case over the phone and arrange to meet the client at her home.
Based on the injuries from this accident and the mounting medical bills, our client decided to retain GJEL Accident Attorneys to help get her life back on track after this tragic accident.
The staff at GJEL started a full investigation which started with getting the police report from the Walnut Creek Police Department. The police report showed that the other driver was 100% at fault and responsible for the accident.
At first, the party at fault’s insurance company was not taking full responsibility and made an offer that the client correctly interpreted as inadequate. As the case went into litigation, the insurance company began to take a different view and became convinced that this was a case that had to be settled. Attorney Jim Larsen helped our client through this difficult time and ultimately was able to settle this case without litigation. This case took approximately ten months to settle. In the end, our client was awarded $100,000 for this accident by the other driver’s insurance company, after aggressive representation.
