About The Accident
Our client was assembling furniture for his new residence on the driveway- pavement in front of his space at the garage shared with other condo owners.
A neighbor, after a short conversation with our client, went to his vehicle, a Toyota Rav 4, backed it out of its garage space, then drove it forward turning, so that the left front tire ran over our client.
The driver then put the Toyota into reverse, running back over our client. The two impacts crushed the injured party’s chest, fracturing ribs which penetrated both lungs and punctured his back, and fracturing his vertebrae.
About The Case
An ambulance was dispatched to the accident scene and the EMTs first administered life-saving measures then transported our client to John Muir Hospital Emergency Trauma Center in Walnut Creek.
There, he was placed on a ventilator and kept on the highest level of ICU, postponing essential surgeries until the medical staff could be reasonably assured of his survival. Once stabilized, our client underwent cardiothoracic surgical procedures over several days to remove the lung-penetrating fractured ribs, fixate the ribs puncturing his back, and clear his respiratory system.
During these procedures, the plaintiff remained in ICU due to his precarious physical condition. Post-surgery, our client continued to experience an elevated level of pain, short-term memory loss, profound depression, and post-traumatic stress disorder. Upon discharge, he required physical therapy, rehabilitation and other assistance because of his physical limitations.
