Accident Overview
On April 6, 2017, our client was standing in his own driveway in Rodeo, California, when a friend pulled into the driveway. The friend didn’t realize he was blocking our client’s wife’s car. Our client advised the friend of that issue. The friend cut his wheel too sharply when backing up and knocked our client down with the side of his car. The accident resulted in the loss of work, moderate injuries, and moderate medical bills leaving our client in a state of uncertainty.
About the Accident
This was a vehicle versus pedestrian accident that resulted in moderate injuries for our client due to the other driver’s negligence. The driver of the car that caused the accident was driving a 2007 Honda.
There were no adverse weather conditions or visibility problems, and the accident happened when the driver mistakenly cut his wheel too hard.
After the accident, our client suffered from severe back pain as well as neck injuries as a direct result of the accident. Our client was transported via ambulance to John Muir Medical Center in Walnut Creek where he underwent treatment for his back and neck injuries. The driver of the car that caused the accident was insured by CSAA insurance.
Case Facts
Our client needed ongoing medical treatment after the accident. At first, CSAA insurance was not willing to pay for our client’s medical bills and other damages.
Our client missed a significant amount of work and was charged up large medical bills from this accident. Based on this information he reached out to GJEL Accident Attorneys to see if he was entitled to compensation and to have his questions answered. He wanted to know:
- Who is responsible for my medical bills?
- How will I pay these bills and the loss of work?
- What if I have permanent lifelong damage to my body?
The staff at GJEL were able to quickly evaluate the case over the phone and a staff member met with the client at his home to obtain more details based on the injuries.
Based on the injuries from this accident and the mounting medical bills, our client decided to retain GJEL Accident Attorneys to help get his life back on track after this tragic accident.
The staff at GJEL started a full investigation which started with getting the police report. The police report showed that the other driver was 100% at fault and responsible for the accident.
At first, the party at fault’s insurance company, CSAA, was of the opinion that the accident was at least partly our client’s fault and offered an amount that GJEL attorneys felt was not sufficient. As the firm continued to collect the evidence the insurance company was convinced to pay their policy limits in this matter.
Attorney Andy Gillin helped our client through this difficult time and ultimately was able to settle this case without litigation. This case took approximately eight months to settle without having to file a lawsuit. In the end, our client was awarded $100,000 for this accident by CSAA company after aggressive representation.
